These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of the website located at https://superiorsanitation.net (the “Site”), as well as any services, products, or content offered through the Site by Superior Sanitation Services, a business operating under the ownership of Catherine Prentice, located in Pine Plains, New York (“Company,” “we,” “us,” or “our”). By accessing, browsing, or using this Site, or by engaging our services for portable toilet rentals, septic pumping, excavation, inspections, repairs, or any other offerings, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. If you do not agree with any provision of this Agreement, you must immediately discontinue use of the Site and refrain from engaging our services.
Superior Sanitation Services, founded in 1975 by Doug Weaver and transferred to current owner Catherine Prentice in January 2025, is committed to providing professional and superior service in a timely fashion. We specialize in comprehensive sanitation solutions throughout Pine Plains, New York, and surrounding communities, including portable toilet rentals (construction toilets, flush toilets, ADA-approved units, luxury event trailers, and RV pump-outs), septic system pumping, installations, inspections, and repairs. These Terms are designed to ensure clarity, fairness, and transparency in our business relationships while upholding our dedication to superior service.
1. DEFINITIONS
To ensure clarity throughout this Agreement, the following terms shall have the meanings specified below:
- “Services” refers to all sanitation-related offerings provided by Superior Sanitation Services, including but not limited to portable toilet rentals, septic pumping, septic system installations, inspections, repairs, excavation work, RV pump-outs, and luxury event trailer provisions.
- “Customer,” “User,” or “You” refers to any individual, business, organization, or entity that accesses the Site, requests information, schedules services, or engages Superior Sanitation Services for any offering.
- “Site” refers to the official website of Superior Sanitation Services located at https://superiorsanitation.net/, including all web pages, content, features, and functionality contained therein.
- “Content” includes all text, graphics, images, logos, videos, audio, software, data, and other materials made available on the Site or in connection with our Services.
- “Agreement” refers collectively to these Terms and Conditions, any supplementary policies referenced herein (including our Privacy Policy), and any written service agreements or work orders executed between the parties.
2. ACCEPTANCE OF TERMS AND ELIGIBILITY
By accessing the Site or utilizing our Services, you represent and warrant that: (a) you are at least eighteen (18) years of age or possess legal parental or guardian consent; (b) you have the legal authority to enter into this Agreement and to bind any entity on whose behalf you act; (c) your use of the Site and Services does not violate any applicable law, regulation, or third-party right; and (d) you will comply with all obligations outlined herein.
We reserve the right, at our sole discretion, to modify, suspend, or discontinue any aspect of the Site or Services at any time, with or without notice. Continued use of the Site following any such changes constitutes your acceptance of the revised Terms. We encourage you to review this Agreement periodically for updates.
3. DESCRIPTION OF SERVICES AND ACCURACY OF INFORMATION
Superior Sanitation Services strives to provide accurate, up-to-date descriptions of our Services, equipment specifications, pricing, and availability on the Site. However, we do not warrant that all information presented is entirely error-free, complete, or current. Service offerings, equipment models, pricing structures, and service areas may change without prior notice due to factors including equipment availability, seasonal demand, regulatory updates, or operational considerations.
All Service descriptions, including details regarding portable toilet features (such as ADA compliance, flush capabilities, or luxury trailer amenities), septic system capacities, installation methodologies, or inspection protocols, are provided for informational purposes. Final service specifications, pricing, and scheduling will be confirmed in writing via email, service agreement, or work order prior to commencement of work. You acknowledge that site-specific conditions, accessibility constraints, soil composition, local permitting requirements, or unforeseen circumstances may necessitate adjustments to the scope, timeline, or cost of Services, which will be communicated to you promptly.
4. USER OBLIGATIONS AND RESPONSIBILITIES
As a Customer engaging Superior Sanitation Services, you agree to:
- Provide accurate, complete, and current contact information, service location details, and project specifications when requesting quotes, scheduling Services, or communicating with our team.
- Ensure safe, unobstructed access to the service location for our vehicles, equipment, and personnel, including adequate clearance for delivery trucks, pumping hoses, excavation machinery, or luxury trailer placement.
- Obtain all necessary permits, approvals, or authorizations required by local, state, or federal authorities for the Services requested, unless otherwise agreed in writing.
- Clearly communicate any site-specific hazards, utility line locations, environmental sensitivities, or access restrictions prior to service commencement.
- Use rented equipment, including portable toilets and luxury event trailers, solely for their intended purposes and in accordance with manufacturer guidelines and reasonable care standards.
- Promptly report any equipment malfunctions, damage, or service concerns to our team to enable timely resolution.
Failure to fulfill these obligations may result in service delays, additional charges, or cancellation of scheduled Services at our discretion.
5. BOOKING, SCHEDULING, AND SERVICE DELIVERY
Service requests may be initiated via phone, email, or the Site’s contact forms. Upon receipt of your inquiry, a representative from Superior Sanitation Services will contact you to discuss your needs, provide a preliminary quote, and coordinate scheduling. Final confirmation of Services, including scope, pricing, timeline, and payment terms, will be provided in writing prior to commencement.
We commit to providing professional and superior service in a timely fashion; however, scheduling is subject to equipment availability, weather conditions, crew capacity, and other operational factors. While we strive to meet agreed-upon delivery and service windows, we cannot guarantee exact arrival times due to variables beyond our reasonable control. You agree to maintain reasonable flexibility regarding scheduling and to notify us promptly of any changes to your availability or site conditions.
For event-based rentals (e.g., luxury trailers, construction site units), we recommend booking well in advance to secure preferred dates and equipment configurations. Last-minute requests will be accommodated whenever possible, but cannot be guaranteed.
6. PAYMENT TERMS AND CONDITIONS
All fees for Services are due as specified in your written service agreement or invoice. Unless otherwise agreed in writing:
- A deposit may be required to secure scheduling, particularly for large projects, multi-unit rentals, or luxury event trailers. Deposit amounts and due dates will be clearly communicated prior to booking.
- Final payment is due upon completion of Services or delivery of rented equipment, unless net terms have been pre-approved for qualified commercial accounts.
- We accept payment via major credit cards, checks, or other methods as communicated at the time of invoicing.
- Late payments may incur interest charges at the maximum rate permitted by New York law, plus reasonable collection costs.
- All fees are quoted in U.S. Dollars and are exclusive of applicable sales, use, or other taxes, which will be added where required by law.
Prices for Services are subject to change without notice. Quotes are valid for thirty (30) days from issuance unless otherwise specified.
7. CANCELLATION, RESCHEDULING, AND REFUND POLICY
We understand that project timelines and event plans may evolve. To ensure fair treatment for all Customers while maintaining operational efficiency, the following policies apply:
- Cancellations by Customer: Requests to cancel scheduled Services must be provided in writing at least forty-eight (48) hours prior to the scheduled service date or delivery time. Cancellations made with less than 48 hours’ notice may incur a cancellation fee equivalent to 50% of the quoted service value, or the full amount if equipment has already been dispatched or specialized preparations completed.
- Rescheduling: Requests to reschedule Services should be made as early as possible. We will accommodate reasonable rescheduling requests subject to availability. Last-minute changes may result in adjusted pricing or availability constraints.
- Cancellations by Superior Sanitation Services: In the rare event we must cancel or postpone Services due to equipment failure, severe weather, crew unavailability, or other force majeure circumstances, we will provide prompt notice and work with you to reschedule at the earliest mutually convenient time. No penalties will apply to Customers in such instances.
- Refunds: Refunds for prepaid Services or deposits will be processed in accordance with the cancellation policy above and applicable law. Refunds for partially completed Services will be calculated on a pro-rata basis, less any non-recoverable costs incurred.
8. EQUIPMENT RENTAL TERMS (PORTABLE TOILETS, LUXURY TRAILERS, ETC.)
For Customers renting portable toilets, luxury event trailers, or other equipment:
- Delivery and Pickup: Delivery and pickup times will be coordinated in advance. You agree to ensure the delivery location is accessible, level, and suitable for the equipment specified. Additional fees may apply for difficult access, extended carry distances, or special placement requirements.
- Use and Care: Rented equipment must be used responsibly and in accordance with the provided instructions. Customers are liable for damage resulting from misuse, neglect, vandalism, or failure to report issues promptly. Normal wear and tear is excluded from this liability.
- Cleaning and Servicing: For multi-day rentals, scheduled servicing (pumping, cleaning, restocking) can be arranged at additional cost. Customers are responsible for basic upkeep between service visits, including preventing overflow and reporting supply needs.
- Loss or Damage: In the event of loss, theft, or significant damage to rented equipment, Customer agrees to pay the replacement cost or repair expenses as determined by Superior Sanitation Services.
- Early Termination: Early return of rented equipment does not automatically entitle the Customer to a refund unless pre-arranged in writing.
9. SEPTIC SYSTEM SERVICES: DISCLAIMERS AND LIMITATIONS
Services related to septic systems, including pumping, installations, inspections, and repairs, are performed by experienced professionals using industry-standard methods and equipment. However, Customers acknowledge and agree that:
- Septic system conditions can vary significantly based on age, design, soil composition, usage patterns, and maintenance history. Our inspections provide a professional assessment based on visible and accessible components, but cannot guarantee detection of all potential issues, particularly those hidden behind walls, underground, or within sealed components.
- Installations and repairs are performed in compliance with applicable New York State and local health department regulations. However, final approval and permitting rest with relevant authorities, and Customers are responsible for securing necessary permits unless otherwise agreed.
- Excavation work carries inherent risks, including potential damage to underground utilities, landscaping, or structures. We utilize utility locating services where required, but Customers agree to indemnify us for damages arising from inaccurate utility markings provided by third parties or undisclosed site hazards.
- No warranty is expressed or implied regarding the long-term performance of repaired or newly installed systems beyond the specific workmanship warranty provided in writing. System longevity depends on proper usage, regular maintenance, and environmental factors beyond our control.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SUPERIOR SANITATION SERVICES, ITS OWNERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR ACCESS TO OR USE OF THE SITE, OUR SERVICES, OR THIS AGREEMENT, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO SUPERIOR SANITATION SERVICES FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE SIX (6) MONTHS PRECEDING THE EVENT.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
11. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Superior Sanitation Services, Catherine Prentice (Owner), and our employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your breach of this Agreement; (b) your use of the Site or Services; (c) your violation of any law, regulation, or third-party right; or (d) your negligence or willful misconduct in connection with site access, equipment use, or project coordination.
12. INTELLECTUAL PROPERTY RIGHTS
All Content on the Site, including text, graphics, logos, images, software, and the compilation thereof, is the exclusive property of Superior Sanitation Services or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any Content without our prior written permission. The name “Superior Sanitation Services,” our logos, and service marks are trademarks of the Company and may not be used without authorization.
13. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our collection, use, and protection of personal information is governed by our Privacy Policy, which is incorporated into this Agreement by reference. By using the Site or engaging our Services, you consent to the practices described therein. We implement reasonable security measures to protect your data, but we cannot guarantee absolute security against unauthorized access or breaches.
14. THIRD-PARTY LINKS AND CONTENT
The Site may contain links to third-party websites or resources (including competitor references for informational purposes) or display content from external sources. These links are provided for convenience only. We do not endorse, monitor, or assume responsibility for the accuracy, legality, or content of third-party sites. Accessing such links is at your own risk, and we encourage you to review their respective terms and privacy policies.
15. MODIFICATIONS TO TERMS AND SERVICES
Superior Sanitation Services reserves the right to modify these Terms and Conditions at any time. Material changes will be communicated via notice on the Site or via email for registered Customers. Your continued use of the Site or Services following the effective date of revised Terms constitutes acceptance of the updates. We also reserve the right to modify, discontinue, or enhance our Service offerings, equipment inventory, or pricing structures with reasonable notice.
16. GOVERNING LAW AND DISPUTE RESOLUTION
This Agreement and any disputes arising out of or related to the Site, Services, or these Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles. Any legal action or proceeding arising under this Agreement will be brought exclusively in the state or federal courts located in Dutchess County, New York, and you hereby consent to personal jurisdiction and venue therein.
In the spirit of efficiency and preserving our commitment to superior service, we encourage Customers to contact us directly to resolve any concerns or disputes informally before pursuing formal legal action. Many issues can be resolved promptly through direct communication with our team.
17. SEVERABILITY AND WAIVER
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. Our failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision unless acknowledged in writing.
18. ENTIRE AGREEMENT AND ASSIGNMENT
This Agreement, together with the Privacy Policy and any written service agreements, constitutes the entire understanding between you and Superior Sanitation Services concerning the subject matter herein and supersedes all prior or contemporaneous communications, proposals, or representations, whether oral or written. You may not assign or transfer your rights or obligations under this Agreement without our prior written consent. We may assign this Agreement in connection with a merger, acquisition, or sale of assets.
19. FORCE MAJEURE
Superior Sanitation Services shall not be liable for any failure or delay in performing our obligations under this Agreement where such failure or delay results from events beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, civil unrest, labor disputes, utility failures, government actions, or severe weather conditions. In such events, we will communicate promptly with affected Customers and work toward reasonable alternatives or rescheduling.
